Brown Bag Lunch attendees kicked off the New Year with another fascinating meeting in January 2023.
One attendee began with an interesting discussion about the value of an estate for probate purposes. The scenario presented was one where a deceased’s family is suing the party that they believe is responsible for the deceased’s death. The BBLer asked for others’ views on if the estate were to have a monetary recovery as a result of that lawsuit, whether that would change the value of the estate as of the date of death. Some attendees were of the view that any damages would not be included as part of the date of death value as that additional “asset” arose after death. Others thought that the estate trustee may have to calculate the likelihood of obtaining damages and include some value for probate purposes on that basis.
