Brown Bag Lunch – February 19, 2019
The OBA’s Brown Bag Lunch (BBL) on February 19, 2019 had members from across the province actively participate in conversations on practice management issues concerning a variety of estates and trusts law topics.
As a refresher, BBLers reviewed a recent blog post by Albert Oosterhoff regarding the correct usage of the two discrete concepts of “power of attorney” and “attorney.”
From there, the discussion moved to compensation of attorneys for personal care. BBLers considered how to calculate compensation terms. Two resources were identified as useful guides: (1) the case of Sandhu (Litigation Guardian of)) v Wellington Place Apartment [2006] and (2) Barry Corbin’s article in the Annual Review of Civil Litigation 2017 which sets out current laws and regulations across Canada with respect to paying legally authorized guardians of personal care. Other related topics trickled into this discussion such as the misappropriation of funds by an attorney.
