The OBA wants your input on recommending changes to The Wishart Act

  • May 24, 2017

As you may be aware, the Ontario Business Law Advisory Council (BLAC) has released two reports to the Ontario government outlining priorities and recommendations for reform of Ontario's corporate and commercial legislation. This includes potential amendments to the Arthur Wishart Act, 2000. The first report was submitted to the Ontario Minister of Government and Consumer Services (MGCS) and can be found here. The second report, released at the beginning of May 2017, is found at this link.

Many of the proposed changes reflect recommendations made by the Ontario Bar Association, Franchise Section, to the BLAC in January 2015 (the OBA Report). Those recommendations can be found here.

The OBA Franchise Section is seeking your input on what other recommendations you may have for reforming the Wishart Act that are not covered in the BLAC’s two reports.

We would appreciate your input being sent to Derek Ronde (Cassels Brock) at dronde@casselsbrock.com and James Elson (OBA) at jelson@oba.org by June 1, 2017. A committee of the OBA Executive will be using this input for the purposes of a further OBA Franchise Section submission.

If you would like to provide your input directly to the BLAC’s Franchise Law Working Group, contact the Group’s chair, Peter Viitre (Sotos LLP) at Pviitre@sotosllp.com.

If you are external counsel and believe that your client may wish to provide input, please advise them to do so.

Thank you for your participation.
