ABOUT THE ROLE CMTO is seeking a Prosecution Counsel to perform prosecution activities and represent CMTO as counsel before the Discipline Committee, Fitness to Practise Committee and the Divisional Court. The Prosecution Counsel also assists the Prosecutions Manager with process development, case management, and file monitoring. KEY DUTIES AND RESPONSIBILITIES • Independently maintain a caseload of prosecution matters, including cases before the Discipline Committee, Fitness to Practice Committee, and Divisional Court. Manage timelines to ensure all deadlines are met. • Negotiate with registrants and/or their counsel regarding statements of facts, joint submissions on orders and undertakings. • Review, draft and edit legal documents including but not limited to legal opinions, statements of facts, joint submissions on orders, undertakings, prehearing conference/case management conference memoranda, affidavits, Disclosure Briefs, and Notices of Hearing. • Prepare for hearings. Review evidence, prepare witnesses and obtain or conduct legal research. • Provide legal advice during investigations, including providing opinions regarding prosecutorial viability. • Attend pre-hearing conferences, case management conferences, Discipline Committee, Fitness to Practise Committee, divisional court hearings as counsel representing CMTO to present agreements or conduct contested proceedings. • Attend College proceedings as college representative as required. • Keep the Prosecutions Manager informed about the flow and disposition of hearings, including timelines and outcomes of assigned matters. Monitor and draw attention to unusual aspects and significant developments in prosecution files. • Assist the Prosecutions Manager with establishing and maintaining efficient and effective policies and procedures. • Participate in unit and department planning, program and priority setting exercises. • Perform other duties as assigned by the Prosecutions Manager. SKILLS • Comprehensive knowledge of litigation practice before courts and/or administrative tribunals. • Expertise in administrative law principles and/ or professional regulation, including knowledge of principles of procedural fairness, natural justice, and relevant case law. • Knowledge of applicable legislative and regulatory framework, including the Regulated Health Professions Act, the Health Professions Procedural Code, Massage Therapy Act, the Statutory Powers Procedure Act, and the Discipline and Fitness to Practice Committees’ Rules of Procedure. • Advanced understanding of regulatory mandate and its application to Discipline and Fitness to Practice prosecutions. • Advanced conflict resolution and negotiations skills. • Excellent written, verbal, and interpersonal skills and ability to effectively establish and maintain professional relationships with all levels of the organization and stakeholders. • Ability to work independently with a commitment to teamwork. • Demonstrated judgment and discretion; ability to maintain the confidentiality of sensitive material. • Proficiency with Microsoft Office applications and ability to work with other specialized applications, such as databases and case management tools. • Proficiency with virtual meeting platforms. QUALIFICATIONS • Bachelor of Laws (LL.B) or Juris Doctor (JD) degree • Practicing Lawyer in good standing with the Law Society of Ontario, with 3-5 years litigation experience. • Experience working with a professional regulator is an asset.
