New LSO Report on Rules Implicated by Use of Generative AI - and How the OBA is Helping You Comply

On April 25, Convocation released its Futures Committee Report on the Rules of Professional Conduct implicated by use of generative AI and the expected levels of competency and best practices.

Some Rules of Professional Conduct that a recent LSO report has cited in relation to the use of AI include:

  • Competence (R 3.1-2) - risk of overreliance, need for basic literacy, and choosing the right product.
  • Confidentiality (R 3.3-1) - need to protect confidential, proprietary, and privileged information.
  • Supervision and Delegation (R 6.1 and 6.2) - need to uphold rule whether receiving assistance from non-licensees or technological tools.
  • Licensee-Client Relationship (R 1.1-1) - flagged that AI chatbots could potentially give incorrect legal advice or lead to other misunderstandings.
  • Fees and Disbursements (R 3.6-1) - can only charge for the time actually spent on the file, even if generative AI made the task more efficient.
  • Discrimination and Harassment (R 6.3 1-1) - generative AI may generate biased or prejudiced responses.
  • Honesty and Candour (3.2-2) - informing clients of use of AI in situations where it may impact the client's interests or outcome on the matter, or where there is concern about the risks of AI technology.
  • Duty Not to Mislead the Tribunal (R 5.1) - abide by any official court notices or guidelines concerning utilization of generative AI in proceedings.
