DEMYSTIFYING: human creativity vs. Artificial Creativity

The more we know, the more AI knows; it can extrapolate and learn based on the collective data it has received, but its capacity for creative thinking and ability to conceive of something brand new are limited. While AI tools can fashion arguments in new ways, perhaps by reorganizing existing ideas, framing them differently, or even combining them in novel ways - these arguments would not be considered novel in the sense of presenting entirely new ideas or concepts that have not been previously explored or discussed. They would be a recombination or reinterpretation of existing information.

RISK: stagnation and lack of sensitivity

Overreliance on AI to generate 'new' (or new-to-you) arguments, rather than applying your own lawyer creativity, could have a stagnating effect on the law. It also runs the risk of offending clients or not adequately responding to their situations or needs, as AI tools won't take into account who your clients are and what might be sensitive to them.

While AI tools can be useful in brainstorming - through thoughtful prompting - artificial creativity (generating content) is no match for human creativity (generating imaginative ideas), and there is no substitute for human sensitivity. Make sure your mind is doing that creative work and leaving room for sensitivity.
