Honour v. Canada (Attorney General), 2008 BCCA 346 (CanLII)

  • September 09, 2008

Date: 2008-09-09 Docket: CA036224 ; CA036223. Bauman J. | Link

The pilot's widow seeks leave to appeal the order in Chadwick v. Canada to produce her husband's computer for forensic analysis. Court declines to grant leave, since the scope covers a limited time period, will be paid for by the defendant, contemplates a search protocol agreed to by the parties (or determined by the court in the absence of agreement), and the search results are to be reported to plaintiff's counsel. Although the court doesn't emphasize it, the order also required review of the documents by an independent counsel to avoid the possibility of disclosure of privileged or irrelevant information.
