The final Brown Bag Lunch meeting of the year was held on December 17, 2024. Trusts and Estates section members were happy to gather one last time before the holidays to share practice tips and discuss some interesting trusts and estates issues.
The December meeting began with a conversation about the occasional difficulty with telling the difference between an original Will and a colour copy. One BBLer mentioned that seeing indentations on the back of the paper could be a helpful indicator, but another pointed out that if the testator signed with a sharpie marker, for instance, it would not necessarily leave an impression. Another attendee noted that their practice is to use different, better quality paper only for original Wills, as another way to help differentiate.
BBLers then had a lively discussion about the recent Ontario Court of Appeal decision, Jackson v Rosenberg, 2024 ONCA 875. Attendees had some thoughts about the consequences of the decision for their practices and shared some considerations in that regard.
One participant shared with the group something she had recently learned on a file about a unique family registry system that exists in Japan, and what impact or obligations it may have on a Japanese citizen or a former Japanese citizen. It is always interesting to hear about niche or unusual issues that arise on fellow BBLers’ files.
